Stan Kucel Lot Line Adjustment
Hi Frank
I got your name from Kassandra Cade-Laymon. I own two lots on Irish Hollow road. One is approx 43 acres and the other is approx. 143 acres. I would like to make them one parcel and I was told that there is a process you have to go through. I was told that you could help me. If so, how would I go about this process? I know that I would have to get an attorney and what else please let me know.

Good morning Stan,
First, apologies for the delayed response. Our board is currently going through some member changes and at the moment do not have a board chair person.
In reviewing Land Use, Subdivision, and Site Plan laws, I could not find anything regarding Consolidating properties. No physical change/alteration to the land is being proposed. No construction is proposed.
However, in the Subdivision regulations, this may qualify as a “Re-subdivison” as defined on page 3 since it changes a lot line on an existing map.
The planning board meets on the third Wednesday of the month at 7pm in the town meeting room at the community center. Your question has been forwarded to members. I will put your question on the agenda for discussion for the March 19th meeting.
If you can attend, please bring a simple hand drawn sketch plan or image of the property lines and proposed change with addresses of the parcels. I can bring up the property maps for members to review.
I look forward to your attendance and a resolution on the 19th.

Addition
My name is Sarah Stewart and I am a project manager at Redpoint. We have been working on the restoration at Willow Hill, 115 Fish and Game Road, which is wrapping up. The homeowners have added renovations to their existing “guest cottage” on the property for which we have a building permit.
The clients have requested we build a 196 sq ft addition for a mudroom and laundry room to their cottage. The Otsego County codes office will ask for proof of local compliance, and I am not certain of the Cherry Valley regulations for additions to existing structures. If there are no further steps then a letter to that affect is enough.

I did a quick review of CV land Use Law. Relevant section below.
Article 4. Land Use and Lot Dimension Standards Section 4.01 Permitted Land Uses
1. Development shall be subject to the Land Subdivision and Site Plan laws of the Town of Cherry Valley. All land use activities within the Town shall require site plan review and approval before being undertaken, except the following:
d. Exterior alterations or additions to existing commercial structures which would not increase the square footage of the existing structure by more than twenty five percent (25%); and having a cost value of less than ten thousand ($10,000.00) dollars. All additions to single family and two-family dwelling units shall be exempt from site
plan review.
The board meets on the third Wednesday of the month in the town meeting room at the community center at 7pm. I will put your question on the agenda for the 19th and forward your question to the board for review. We can then draft the appropriate letter for you.
